Terms of Service
1. Acceptance
By creating an account or using Touristy ("the Service"), you agree to these Terms. You must be 18 or older, or have parental or guardian consent. If you do not agree, do not use the Service.
2. The Service
Touristy is a travel-document organization, itinerary, and AI-assisted planning tool. We do not issue tickets, hotel bookings, or financial advice. AI outputs are informational; verify critical details (flight times, addresses, prices) yourself before relying on them.
3. Accounts
You are responsible for keeping your credentials safe and for all activity under your account. We may suspend or terminate accounts that violate these Terms or applicable law. Notify us at hello@touristy.ai if you suspect unauthorized use.
4. Plans, billing, and 30-day money-back guarantee
Subscriptions auto-renew at the displayed price each billing cycle (monthly or annual) until you cancel.
Cancellation takes effect at the end of the current paid period; you keep access until that date. Cancel anytime from your /billing page (Stripe Customer Portal).
30-day money-back guarantee: We will issue a full refund of any first-time payment (Pro or Family, monthly or annual) if you email hello@touristy.ai within 30 days of the charge. We process refunds within 5 business days. After 30 days, no refunds are issued except as required by law.
Family plans: Cancellation by the paying owner downgrades the entire group to the Free tier; existing members keep read-only access to their content.
Failed payments: If your card fails, Stripe retries automatically. After Stripe's retry window ends, paid features are revoked. Your data remains accessible read-only; resubscribe at any time to restore full access.
Tax: Prices are exclusive of applicable taxes (e.g., HST in Ontario). Stripe Tax computes and adds tax at checkout based on your location.
5. Acceptable use
You agree not to: scrape or automate the Service beyond normal use; resell or redistribute access; abuse AI features (e.g., excessive batch calls); upload content you do not have rights to (including third-party booking data you obtained without authorization); or use the Service for any unlawful purpose.
6. Your content
You retain ownership of all content you upload (documents, trip data, chat messages). You grant us a limited, non-exclusive license to process that content solely to operate the Service for you (running document classification, generating itineraries, displaying your dashboard, processing AI chat). The license terminates when you delete the content or your account.
7. Termination
You may terminate at any time by deleting your account. We may terminate for material breach of these Terms with reasonable notice (except in cases of fraud or legal compulsion, where notice may be immediate). Upon termination, your data is erased per our Privacy Policy retention schedule.
8. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. AI outputs may be incorrect or incomplete. We do not guarantee the Service will be error-free or uninterrupted.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of CAD $100 or twelve (12) months of fees paid by you to us. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada, excluding its conflict-of-laws provisions. Any dispute arising from these Terms or the Service shall be brought exclusively in the courts of Toronto, Ontario.
11. Changes
We may update these Terms from time to time. Material changes are notified by email at least 14 days before they take effect. Continued use after the effective date is acceptance of the updated Terms.
